Terms and Conditions - Car Rental in Agadir, Morocco

These General Terms govern the rental of vehicles by MCHDF CARS in Morocco. Any rental implies full acceptance of these terms, supplemented by the Specific Conditions stated in the Rental Agreement.

Conditions for Renting

• Minimum age: 21 years old.
• Driving licence: must have been held for at least 2 years.
• Required documents: official photo ID, valid driving licence, and a credit card in the name of the main driver (cash payment accepted only if agreed).
• International licence: required if the licence is issued in a non-Latin alphabet.

Renter's Obligations

The renter agrees to:

• Keep the vehicle in good condition and avoid any damage or loss.
• Not transport illegal goods or substances.
• Not use the vehicle for paid transport or competitions.
• Not tow another vehicle.
• Not drive under the influence of alcohol or drugs.
• Pay all fines, penalties, and charges related to the use of the vehicle during the rental period.
• Respect the agreed daily mileage (200 km/day, 2 MAD/km extra).
• Notify MCHDF CARS and the authorities in case of an accident and fill out an accident report if needed.
• Use the vehicle in compliance with applicable laws.

Insurance and Liability

• Third-party liability insurance is included, with any deductible specified in the contract.
• The renter is liable for:
  • Damage caused by negligence or improper use.
  • Costs related to loss or theft of the vehicle or its documents.
  • Damage caused to third parties through their own fault.

Security Deposit and Payment

• A deposit may be required depending on the vehicle and payment method.
• Payment must be made according to the agreed method (cash or credit card).
• Late return or late payment will incur penalties.

Vehicle Return

• The vehicle must be returned on the agreed date and time, in the original condition (normal wear accepted).
• Any extension requires prior approval from MCHDF CARS.
• Late returns will be charged at the applicable daily rate plus any penalties.

Loss, Theft or Damage to Documents

In case of loss of vehicle documents, the renter must:

• Immediately notify MCHDF CARS.
• File a declaration with the authorities.
• Pay the cost of replacement.

Jurisdiction

All disputes fall under the exclusive jurisdiction of the courts of Agadir, Morocco.

Governing Law

Any matter not provided for herein is subject to the Moroccan Code of Obligations and Contracts and other applicable laws.
